This store is operated by ROAS 3 LLC, trading as Sophie and Dan ("Sophie and Dan", "we", "our", "us"), and this policy, together with the content, products and services on the site, makes up what we call the "Services".
The store runs on Shopify Inc.'s e-commerce platform, which hosts the site and supports us in offering the Services.
This Privacy Policy sets out which personal information we collect, why we collect it, how we use and protect it, and the rights available to you, including residents of California, Virginia, Colorado, Connecticut, Utah, Texas and other states with consumer privacy laws. Visiting the site or placing an order means you have read and understood this policy.
1. Information we collect
Depending on how you use the store, we may collect:
- Identity and contact details: name, email address, phone number, billing and shipping address.
- Payment details: card information, payment confirmations and transaction records, processed through our payment providers. We never see or hold full card numbers.
- Account details: login information, password, saved preferences and settings.
- Purchase history: products you view, add to cart, buy or return.
- Technical details: IP address, browser type, device and operating system, cookie identifiers, and how you navigate the site.
- Support details: the content of emails or messages sent to customer service, including attachments.
This reaches us in three ways:
- directly from you, for example when placing an order, creating an account or contacting us,
- automatically, through cookies and similar technology as you browse,
- through third parties that help run the store, such as Shopify and our payment providers.
2. How we use it
- Operating the store: processing payments, shipping orders, handling returns and refunds.
- Improving your visit: remembering preferences and showing relevant content.
- Communication: order confirmations, shipping updates, answering questions and support.
- Marketing: where permitted, sending offers or showing relevant ads. You can unsubscribe at any time through the link in our emails.
- Protection and fraud prevention: securing accounts, spotting suspicious activity and keeping payments safe.
- Legal obligations: complying with the law, responding to valid requests and enforcing our Terms of Service.
3. Who we share it with
We share personal information only where necessary, with:
- Shopify Inc., which hosts the store and processes orders for us,
- payment providers and delivery partners, so payments complete and parcels reach you,
- service providers for IT, analytics, advertising and email, who support running the store,
- public authorities or courts, where legally required.
Every partner is contractually bound to protect your information and use it only for the agreed purpose.
4. Selling and sharing
We do not sell personal information for money. Like most online stores, we use advertising and analytics services (Google, for example) that may receive information about your visit through cookies or tags; under some state laws this counts as sharing personal information for targeted advertising. You can opt out at any time by emailing info@sophieanddan.com or sending a Global Privacy Control signal from your browser, which we honour where the law requires it. We do not use or disclose sensitive personal information beyond what the law permits.
5. Shopify
Because the store runs on Shopify, Shopify also collects and processes certain information (cookies and device data, for example) to operate the platform and provide analytics. 6. Where information is handled
We are based in the United States. Your information may be stored on servers in the United States, Canada or the European Union, including those used by Shopify and our service providers. Wherever it is handled, it stays protected under this policy and our contracts with those providers.
7. How long we keep it
We keep personal information only as long as needed:
- to fulfil your orders and provide the Services,
- to meet legal and tax obligations,
- to resolve disputes, and
- to enforce our agreements.
Once no longer needed, information is securely deleted or anonymised.
8. Your rights
Depending on where you live, you may be able to:
- find out what personal information we hold about you and get a copy,
- have inaccurate information corrected,
- have your personal information deleted,
- opt out of the sale or sharing of your personal information and of targeted advertising,
- limit the use of sensitive personal information, and
- receive your information in a portable format.
To exercise any of these, email info@sophieanddan.com. We may ask you to verify your identity first, and you may use an authorised agent to act on your behalf. We respond within 45 days, telling you if we need up to 45 more. Exercising a privacy right never affects how we treat you. If you disagree with our decision, you may appeal by replying to our response; appeals are answered in writing within 45 days (60 days in Colorado and Connecticut), and if an appeal is denied we explain how to complain to your state's attorney general. California residents may also ask, once a year, about disclosures made to third parties for their own direct marketing; we make none.
9. Do Not Track and opt-out signals
Our site does not currently respond to browser Do Not Track signals. We treat a Global Privacy Control signal as a valid opt-out from the sharing of personal information for targeted advertising where the law requires it. Third parties such as Shopify and our analytics and advertising providers may track your activity on our site over time; we do not direct them to track you across other sites on our behalf.
10. How we protect it
We apply reasonable technical and organisational measures to keep personal information secure, though no system connected to the internet can be made fully secure, so we cannot promise complete protection of information in transit.
11. Children
The Services are not aimed at anyone under 18, and we do not knowingly collect personal information from children under 13, consistent with the Children's Online Privacy Protection Act. If you believe a child has given us personal information, contact us so we can remove it.
12. Changes to this policy
We may update this Privacy Policy from time to time, for example as our practices or the law changes. The current version is always published here with an updated date, and we will flag any significant change clearly on the site.
