This online store is operated by Sophie Stone B.V., trading as Sophie and Dan ("Sophie and Dan", "we", "our", "us"). Together with all related content, products and services, we refer to it as the "Services".

Our store runs on the e-commerce platform of Shopify Inc., which hosts our website and supports us in providing the Services.

In this Privacy Policy we describe which personal information we collect, why we collect it, how we use and protect it, and which rights you have, including the rights available to residents of California, Virginia, Colorado, Connecticut, Utah, Texas and other states with consumer privacy laws. By visiting our website or placing an order, you confirm that you have read and understood this policy.

1. What information we collect

Depending on how you interact with our store, we may collect:

  • Identity and contact information: your name, email address, telephone number, billing address and shipping address.
  • Payment information: card details, payment confirmations and transaction records, processed through our payment providers. We never see or store full card numbers.
  • Account information: login details, password, saved preferences and settings.
  • Purchase information: products you view, add to your cart, buy or return.
  • Technical information: IP address, browser type, device and operating system, cookie identifiers and how you move through our website.
  • Support information: the content of the emails or messages you send to our customer service, including any attachments.

This information reaches us in three ways:

  • directly from you, for example when you place an order, create an account or contact us,
  • automatically, through cookies and similar technologies while you browse our website,
  • through third parties that help us run the store, such as Shopify and our payment providers.

2. Why we use your information

  • Running the store: processing payments, shipping your orders and handling returns and refunds.
  • Improving your experience: remembering your preferences and showing you relevant content.
  • Communication: sending order confirmations and shipping updates, answering your questions and providing support.
  • Marketing: where permitted, sending you offers or showing you relevant ads. You can unsubscribe at any time through the link in our emails.
  • Protection and fraud prevention: protecting accounts, detecting suspicious activity and keeping payments secure.
  • Legal obligations: complying with applicable laws, responding to legitimate requests and enforcing our Terms of Service.

3. Who we share your information with

We share personal information only when necessary, with:

  • Shopify Inc., which hosts our store and processes orders on our behalf,
  • payment providers and delivery partners, so that payments can be completed and parcels can reach you,
  • service providers for IT, analytics, advertising and email, which support the operation of our store,
  • public authorities or courts, where we are legally required to do so.

All partners are contractually required to protect your information and to use it only for the agreed purpose.

4. Selling and sharing

We do not sell your personal information for money. Like most online stores we use advertising and analytics services (for example Google) that may receive information about your visit through cookies or tags; under some state laws this counts as sharing personal information for targeted advertising. You can opt out at any time by emailing info@sophieanddan.com or by sending a Global Privacy Control signal from your browser, which we honor where required by law. We do not use or disclose sensitive personal information for purposes other than those permitted by law.

5. Shopify

Because our store is built on Shopify, Shopify also collects and processes certain information (such as cookies and device information) to run the platform and provide analytics. 6. Where your information is handled

We are based in the Netherlands. Your information may be stored on servers located in the United States, Canada or the European Union, including the servers of Shopify and our service providers. Wherever it is handled, it is protected under this policy and the contracts we have with those providers.

7. How long we keep your information

We keep personal information only for as long as necessary. In practice this means we keep it:

  • to fulfill your orders and provide the Services,
  • to meet legal and tax obligations,
  • to resolve any disputes, and
  • to enforce our agreements.

When information is no longer needed, it is securely deleted or anonymized.

8. Your rights

Depending on where you live, you may have the right to:

  • know what personal information we hold about you and receive a copy of it,
  • have inaccurate information corrected,
  • have your personal information deleted,
  • opt out of the sale or sharing of your personal information and of targeted advertising,
  • limit the use of sensitive personal information, and
  • receive your information in a portable format.

To exercise any of these rights, email info@sophieanddan.com. To protect your information we may ask you to verify your identity first. You may also use an authorized agent to make a request on your behalf. We respond within 45 days, and we will tell you if we need up to 45 more. You will never be treated differently for exercising your privacy rights. If you disagree with our decision, you may appeal by replying to our response; we answer appeals in writing within 45 days (60 days in Colorado and Connecticut), and if we deny an appeal we tell you how to submit a complaint to the attorney general of your state. Residents of California may also request, once a year, information about disclosures to third parties for their own direct marketing purposes under the "Shine the Light" law; we do not make such disclosures.

9. Do Not Track and opt-out preference signals

Our website does not currently respond to browser Do Not Track signals. We treat a Global Privacy Control signal as a valid request to opt out of the sharing of personal information for targeted advertising where required by law. Third parties such as Shopify and our analytics and advertising providers may collect information about your activity on our website over time; we do not direct them to collect it across other websites on our behalf.

10. How we protect your information

We take appropriate technical and organizational measures to keep your personal information secure. At the same time, no online system can ever be completely secure, so we cannot promise absolute protection of information transmitted over the internet.

11. Children

Our Services are not directed at persons under 18 and we do not knowingly collect personal information from children under 13, in line with the Children's Online Privacy Protection Act. If you believe a child has provided us with personal information, contact us so we can remove it.

12. Changes to this policy

We may revise this Privacy Policy from time to time, for example when our activities or the legal requirements change. The most recent version is always published on this page with an updated "Last updated" date. If the changes are significant, we will say so clearly on our website.
